data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <strong>What the appeals court said:<\/strong> In the\u00a0<a href=\"https:\/\/www.cnn.com\/2024\/02\/06\/politics\/trump-immunity-court-of-appeals\/index.html\" target=\"_blank\" rel=\"noopener\">opinion<\/a>, the judges found that if proven, the former president\u2019s efforts to usurp the 2020 presidential election were an \u201cunprecedented assault on the structure of our government.\u201d\u00a0The judges also <a an assault on an American institutions.\n    <\/p>\n<p data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph-842f2dc34bc5e2364912eaaba17184ce@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cFormer President Trump lacked any lawful discretionary authority to defy federal criminal law and he is answerable in data-article-gutter=\"true\">\n            Even his stances in court, the judges wrote, stand in contrast to the principle that all Americans \u2013 including former presidents \u2013 are subject to responsibility to handle the criminal prosecution of a former president.\n    <\/p>\n<p data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph-f1dcdbb1663c1a6f0260722f2bade7df@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            One question that has come up repeatedly in this case is if the court system has the ability to try a former president who faced an impeachment proceeding in Congress, and if they can look at the presidential immunity question before a trial.\n    <\/p>\n<p data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph-e6706a5d5201b008aa303a87e7049ec5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            On both fronts, the appellate judges said they could.\n    <\/p>\n<p data-article-gutter=\"true\">\n            While a president and even others in the government, like legislators and judges, could be protected from lawsuits, they can be criminally prosecuted, the
